The good news is that thousands of motorists from other parts of the country who were trapped at high speed by traffic cameras on roads in and around Cape Town in the past two years have evaded prosecution, because Labat Traffic Solutions won't serve summonses outside the city limits. Also if your cars registration papers features a P.O. Box address then you also would not have received any summons and will escape fines. (Tip : Make sure that you get a P.O.Box address).
I would like to thank the state contractor Labat Traffic Solutions for not serving court summonses, “simply not doing its job". Labat Traffic Solutions Western Cape project manager Shaheed Mohamed admitted yesterday that the company did not serve court summonses on motorists who had committed excessive speeding offences if they live outside Cape Town CBD. Speeding motorists also escaped prosecution if the addresses found for them were post box addresses, he said. Before Labat won this contract, the traffic department was hiring sheriffs of the court to trace speeding motorists around the country," Metro Police spokesman Nowellen Petersen said the speeding motorists who were not served court summonses were "the untraceables". (Yippee) Tip : Dont pay the fine unless you get a summons or the sheriff of the court comes knocking on your door. |

Yes you can contest your fine by sending a letter stating your reasons, along with a copy of your fine, to the Gallows Hill Traffic Department. You can also fax the information to 021 421 6607. You should receive an acknowledgement of receipt from the traffic department in month.
The Traffic Manager will then send your letter to the relevant court. The Public Prosecutor at the court will review the fine, which takes a maximum of two days, after which the letter and the decision will be sent back to the Traffic Manager, where it is re-captured. This process takes approximately three weeks. The whole process takes about six weeks. You can also contact the Public Prosecutor directly at the court that appears on your fine. If you have received a summons, you should write to the Public Prosecutor before the date you are due to appear in court. Tip: If you write the Prosecutor a letter the fine will be reduced by 50%. |

Thanks for sharing your tips guys. Here is another tip to beat speed cameras:
Number plate spray, which has been sold in the US for about five years, appears to reflect the flashes of speed cameras so that it obscures the car registration in the photograph, but the number plate can still be seen with the naked eye. It works because its like taking a picture of a mirror, the spray is not illegal because of a loophole in the law. The law doesn't say that your car has to be photogenic. The law states that no physical obstructions should be placed on registration plates and that the numbers should not be altered, but not that you must ensure that speed cameras can take pictures of your plates. Its called RADAR FLASH BLOCKING SPRAY and you can buy it on bid or buy for R225 per canister. |

Cape Town City has lost a lot of cash through the expiry of warrants of arrest and will have to approach the courts to withdraw 94 000 warrants, valued at R48m, which expire after two years.
It will also be forced to cancel 68 627 camera fines, with a value of R18m, as offenders were not summonsed within the required 18 months. Labat Traffic Solutions was hired to assist in issuing fines and warrants two years ago, but this has been ruled as illegal by the National Prosecuting Authority. Labat now only assists in administrative duties related to traffic fines. Cape Town city was forced to cancel all warrants of arrest older than two years, and all camera cases not summonsed within 18 months. From August , there were 287 000 warrants of arrest outstanding, with a value of R165m. I just want to thank the National Prosecuting Authority for cancelling Labats contract, and please dont change any of the current policy. |

If the camera fine's notice number starts with a 9 or 4, it can be viewed at www.payfine.co.za.
To view your photos you will need to know: * The municipal district in which the photo was taken * Your vehicle registration number * The film number, which appears in the traffic fine. Camera fines that start with a 2 can only be viewed at Parow Traffic, Oostenberg Traffic, Helderberg Traffic, Milnerton Traffic South Peninsula Traffic and Cape Town Traffic between 8.30am and 3pm. Don't pay them unless conclusive. |

Hi guys,
What I wanted to tell you and all your readers of the forum is that there is a book out there called " How to get off your speeding fine LEGALLY!" This manual contains legal information in regard to the rules governing the implementation of Speed Law Enforcement. It enables you ensure that when you are accused of a speed violation, the prosecution against you is absolutely legal and correct and that the laid down requirements pertaining to speed trapping were all correctly in place. I have successfully used this manual to get off speeding fines four times! It gives you everything you need to know about speed traps AND roadside arrests for non payment of fines! It shows you how some of the traps are totally ILLEGAL!
